why you need to make a will

Why you need to make a will.

Though it might not be the cheeriest thing to think about, death, let’s face it, is inevitable. Plans for what comes after which is usually something we avoid thinking about, however unless you begin to accept that one day, hopefully way off in the future, you are going to die, you may ultimately be ridding your family and friends of the bits and bobs you want left to them.

More than half of people in the UK have not made a will, if you die without making a will, then Intestacy Rules will be used to decide who should receive your property regardless of who you want it to go to. This can be unfair to your family and friends, leading to complication most of all to unmarried co-habiting couples. You have to remember that the person who is legally recognised as your next of kin may not necessarily be the person you either think it is, or the person you wish to have your property when you are gone.

To avoid all this kafuffle, you, and everybody, should consider making a will. This way you can ensure if anything was to happen, however unlikely it may seem, all your property and finance is sorted, leaving no extra worry for your family. Another example would be if you are going through a divorce, until a Decree Absolute is pronounced your spouse remains your next of kin, despite how long you may have been separated, and will be entitled to your property according to the Intestacy rules Decree Absolute ends an ex-spouse’s entitlement unless a Will makes specific alternative provision.

If you and your partner live together, your partner is not your next of kin, despite of how long you may have been together, according to the Intestacy Rules, meaning when you die they are not entitled to your property unless specified in your will. Co-habiting couples have no legal standing as a couple, they are only entitled to property that is legally classed as joint property.

So having read that I’m sure you will agree that making a will is the one and only way to ensure your property is in the hands of those you wish it to be after your death, is to make a will. What are you waiting for? Get in touch now, you never know what the future may hold, and the result of delaying your will may be devastating.
